The name of the organization shall be ICC Region 5.
The principal office shall be located within the four-state area of ICC Region 5, defined as Indiana, Kentucky, Michigan, and Ohio, or in such other place as the members may designate. The organization may have such other office, as the business of the organization may require as determined by the members.
The purpose of this organization, in the ICC Region 5 area, shall be:
To bring together individuals engaged in the administration and enforcement of building and other related codes to share information, experience and policy, exchange ideas, discuss mutual problems and establish uniform interpretation of all applicable codes.
To encourage and assist in efficient administration and enforcement of building and related codes, and to uphold and improve the prestige of code enforcement professionals.
To promote maximum safety to life, health and property at minimum costs.
To create a better public understanding and appreciation of construction regulations and their importance to the safety, health and prosperity of the communities.
Through cooperation, to assist, educate, and encourage the organization and maintenance of professional standards of training for all individuals involved in the construction industry.
To promote a program of legislation which will be to the benefit of the public and which will develop an increased level of safety to life and property in buildings and other structures.
To coordinate and cooperate with other governmental agencies involved in the administration of building regulations, design professionals and their respective organizations, and the construction industry.
To foster personal and professional support and to promote an information network among jurisdictions.
To secure and maintain support of other state and local governmental agencies and officials in these goals and purposes set forth by this organization.
To aid, educate, and assist members in the pursuit of the goals and objectives of this organization.
This organization shall not make any effort to formulate a building code or other related codes for adoption be any legislative authority. It shall not, however, be prohibited from the recommendation of or the recommendation of the revision to any model code, and provided that any recommendation must be approved by a majority of the members present at a regular or special meeting.
The methods of achieving the purposes of this organization shall be:
By cooperation with other states, public officials, and associations;
By exchanging and disseminating, through whatever means directed or approved by the Board of Directors;
By maintaining in public office a high degree of integrity and public relations;
By creating good fellowship and mutual understanding, among members and with industry through meetings and similar activities;
By publicizing the purposes and activities of this organization through contact with public officials in other branches of government and representative of the construction industry;
By recognizing and accepting recommendations of established building code organizations and standards authorities so long as they are consistent with sound safety practices;
By recommending, for every jurisdiction in our region, the adoption of coordinated building codes based upon unbiased judgment and developed in a public forum;
By establishing and collecting dues, fees and other income for the furtherance of the objectives of the organization.
The organization shall have the power to adopt bylaws which may provide for:
Various classes of membership and fixing the qualifications therefore;
Amount and conditions of payment of dues;
The designation of Officers, Board of Directors, their duties, methods of election and term of office;
The establishment of committees and the employment of personnel;
The holding of meetings;
Amending this constitution and bylaws;
Such other matters as may be necessary to the fulfillment of the objectives of the organization.
All assets of this organization shall be exclusively used in furtherance of its purpose herein set forth. No officer, member or employee of the organization, nor any other individual, corporation of interest shall at any time receive or be lawfully entitled to receive any pecuniary profit from the operation or activities of this organization, nor any net earnings thereof, except reasonable compensation for services and reimbursement of necessary travel and incidental expenses incurred in furtherance of the objectives of the organization, as approved by The Board of Directors.
Upon the dissolution or termination of this organization, no officer, member or employee of the organization, nor any other individual shall receive any profit from or share in any of the assets or property of the organization; but all assets, property and surplus of the organization shall be delivered to vest in an existing organization as nearly similar as may be possible and containing in its constitution provisions having the same effect as those contained in Article II of this constitution.
In case all the assets of this organization are expended or distributed in accordance with the provisions of this constitution, the organization may be dissolved or terminated.
